RESIDENTS living in a £325,000 newbuild just 9ft from a 70mph A-road say the council are helping their neighbours – but they’re getting nothing.

Residents of the estate were also warned to avoid eating any vegetables grown on their own land, as it could contain poisonous soil.

North Warwickshire Borough Council, after neighbours complained about the project, promised to install an acoustic fencing around it, triple-glaze their windows, as well as improve ventilation.

Jayne Snelson and Robert Snelson, a couple in rage said that they were “offered” nothing and wished they would have made more of a fuss.

Jayne said, “We’re just as near as they are and haven’t been offered anything.”

“We should have made a fuss because we’d take anything to lower the volume.

The noise will crack you up after a few minutes. It’s relentless.

The couple moved into their home after relocating from Cyprus and had not appreciated just how noisy the road was.

There will not be an acoustic fencing or triple-glazing for them.

Residents already deal with a double carriageway that is clogged up by traffic.

It makes their fences shake and causes some residents to wear ear-plugs while inside their “dream homes”.

Jackie and James McCormack won the court case they had against the Council after they moved into their 3-bed property in Febuary 2021.

Within a day the pair realised their £325,000 home – just nine feet from a busy A road – was completely unliveable.

When Central Recorder visited the grandparents at their property in Coleshill, Warwickshire, noise levels smashed 85 decibels when a wagon rattled past.

North Warwickshire Borough Council warns that soil samples taken from gardens in the area may have been poisoned.

Unnamed resident: We actually requested assurances that soil contamination was not present before purchasing the land.

It could be that the site used to house underground fuel storage.

The Council should take action to remedy the situation.

North Warwickshire Borough Council issued a press release in which they said that “North Warwickshire Borough Council is generally of the opinion that it was not met its obligation to discharge noise properly. We apologize for this.”

The Council offered to pay for the work that was required by the condition of noise.

This offer has now been taken up.

The Ombudsman commended Council for its efforts to correct the error, despite the original mistake.

“The Council has exceeded what the Ombudsman had required them to.”

She continued: “Each individual planning application will be considered within its context.

The first permission to build houses on this site was given in 2008.

The Ombudsman concluded that there was no fault on the part of the Council in relation to this scheme.
